Kocian, 100 South Road (11-62)   Chris Alley presented a septic construction permit application to replace an existing cesspool with a new Title-5 compliant system.  A variance to Chilmark Board of Health regulations is required to reduce the leach-field-to-property line separation from 30’ to 13’.  Katie Carroll noted that the system is close to vegetation bordering the road, and felt that she would rather see the separation between the leaching field and the property’s well reduced slightly, than see the vegetative barrier destroyed.  The Board approved the application.

Madoff, 16 Nickerson Farm Lane (21-9.3) Reid Silva discussed a proposed renovation/addition to the dwelling at 16 Nickerson Farm Lane.  The tank-and-pit septic system currently in place dates back to 1984.  It has a 330 gpd capacity and is permitted for three bedrooms.  According to the house plan, there are currently four bedrooms in the dwelling; the proposed addition would result in a four-bedroom house.  Reid Silva inquired whether the Board could approve continued use of the current system, as it would be very hard if not impossible to build a Title 5 compliant system on the lot.

Katie Carroll noted that the house is not entitled to four bedrooms under the current system.  Due to the constrictions of the property in question, it is not possible to approve more than three bedrooms for the property.  The existing fourth bedroom is grandfathered at this time, but any new construction or major renovation will have to result in a three-bedroom dwelling.  

Road Race,  The Board reviewed a plan for the Chilmark Road Race, scheduled for Saturday, August 13, 2011, submitted by Hugh Weisman.  The plan calls for two toilets at the bus unloading area at Tea Lane, another three between there and the Start near Hewing Field Road and another five at the Start Line.
Additionally, there will be volunteers at the Tea Lane and Hewing Field toilets to let
runners know that there will be additional toilets further along as well as posting appropriate signage along the route.  The Board approved the proposed Road Race Sanitation Plan.

Packer, 511 North Road, (27.1-96,97,98)  The Board reviewed an as-built letter and plan submitted by Reid Silva for the Menemsha Market.

Bernstein, 17 Chowder Kettle Lane, (27.1-166)  The Board noted receipt of a potability test for the private well at 17 Chowder Kettle Lane.  The test passes in all parameters tested.

Wlodyka, 4 Beech Grove, (13-43.3) The Board took note of the as-built received for the property; the certificate of compliance was issued.

Liman, 34 Blacksmith Valley Road, (35-38)  The Board took note of the as-built received for the property; the certificate of compliance was issued.

Food Establishment Inspections :  The following Food Establishments were inspected since the last meeting of the Board:  Homeport, Chilmark Tavern, Galley, The Bite, All-Island Seafood, Larsen’s Fish Market, Menemsha Inn, and Menemsha Market.

Inspection of PWS #4062006   Marina Lent reported on a review of the public water system at the Chilmark Library and Community Center on 7/19/2011, which Chuck Shurtleff of the Massachusetts Department of Environmental Protection (DEP), Chilmark Custodian Rodney Bunker, and Library Director Ebba Hierta attended.  The DEP has approved the town’s application for a sediment filter at the Library and a pH filter at the Chilmark Community Center.

Eddy, 14 Welles Way, (25-7.6)  Marina Lent reported on a Rat Control Patrol, at the Eddy guest house at 14 Welles Way.  Mike Renahan stressed that the Board does not seek any involvement whatsoever in any rat-control issues.

Recycling bins at Menemsha  The Board welcomed the proposal for the Town to provide recycling bins at Menemsha.

BOH Administrator/Inspector Office Hours:  The Board determined that Marina Lent is insufficiently accessible during posted office hours of 8:30am to 2:30pm.  Since the job does include a significant portion of field work, scheduled out-of-office work in future will only take place on Wednesdays and Fridays.

State Lab Institute test   The Board determined that the raccoon in question appears to have been located in Aquinnah, not in Chilmark.  The Board expressed satisfaction that the raccoon, which had been killed by a dog, tested negative for rabies on 7/6/2011.

Invoices:  The following invoices were approved for payment:

  • MVRD SEMASS and transportation/transportation recycling  $3,163.15
  • White-Lynch Bros.  Berm-repair at LDO   $362.67
